Terms of Service

1. Acceptance of terms
By registering for or using any part of the High Scholar platform, you agree to be bound by these Terms of Service ('Terms'). If you are accepting on behalf of an organisation (a school or institution), you represent that you have the authority to bind that organisation. If you do not agree to these Terms, do not use the platform.
2. Description of service
High Scholar provides a connected school management platform comprising: (a) a web-based Teacher application for class and curriculum management; (b) a Learner mobile application for academic tracking and communication; and (c) a Parent mobile application for monitoring learner progress. Features vary by subscription plan.
3. Account registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of any unauthorised access to your account.
- Accounts are personal and may not be shared or transferred without our written consent.
4. School administrator responsibilities
Schools subscribing to High Scholar designate at least one administrator responsible for: managing user accounts within the institution, ensuring staff and learner data is accurate, configuring appropriate access permissions, and ensuring that all users within the institution comply with these Terms.
5. Acceptable use
- Use the platform only for lawful educational purposes.
- Do not upload content that is illegal, defamatory, discriminatory, or in violation of any third-party rights.
- Do not attempt to reverse-engineer, decompile, or disassemble any part of the platform.
- Do not use automated tools to scrape, index, or harvest data from the platform.
- Do not impersonate another user, staff member, or representative of High Scholar.
6. Intellectual property
High Scholar and its licensors own all intellectual property rights in the platform, including software, design, trademarks, and content created by High Scholar. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for its intended educational purpose. You retain ownership of all content you upload.
7. Payment and subscription
Subscription fees are billed in accordance with the plan selected at checkout. Fees are non-refundable except where required by the Consumer Protection Act 68 of 2008. Failure to pay may result in suspension or termination of access. All prices are quoted in South African Rand (ZAR) and are inclusive of applicable VAT.
8. Suspension and termination
We may suspend or terminate access, with or without notice, if: (a) you materially breach these Terms; (b) payment is overdue by more than 30 days; or (c) continued operation poses a security or legal risk. Upon termination, your right to use the platform ceases immediately and data retention provisions of the Privacy Policy apply.
9. Limitation of liability
To the fullest extent permitted by South African law, High Scholar's total liability arising out of or related to these Terms or the platform shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Johannesburg, Gauteng.
11. Amendments
We reserve the right to modify these Terms at any time. We will provide at least 14 days' advance notice for material changes. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
